Terms and Conditions

Please read these Terms and Conditions carefully before using Czech Learner at https://czech-learner.com (the "Service"), operated by Slouch s.r.o. ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least 16 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, you must not use the Service.
2. Description of the Service
Czech Learner is an online platform for learning Czech. It provides authored courses (“paths”) made up of units and lessons, spaced-repetition drills built from your own vocabulary, reading practice, audio pronunciation, and features powered by artificial intelligence including a conversation tutor, translation and sentence analysis.
The A1 path is free and complete. It requires no payment and no payment card. Later paths and vocabulary packages are bought once and owned permanently, as described in section 4.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practical. This does not affect access to content you have already bought, which is dealt with in section 4.
3. Account Registration
You must register an account to access most features. You agree to:
— Provide accurate and complete registration information.
— Keep your password secure and not share it with others.
— Notify us immediately at slouch.web@gmail.com if you suspect unauthorised access to your account.
— Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Purchases and Payment
We do not sell subscriptions. There is no recurring charge, no renewal date and nothing to cancel. Everything for sale on Czech Learner is bought once.
All payments are processed securely by Stripe. We do not receive or store your card details. By making a purchase you also agree to Stripe's terms of service.
What you are buying: a named item — a learning path, a bundle of paths, or a vocabulary package — identified at checkout, together with the lessons, exercises and vocabulary it contains at the time of purchase and any later additions we make to it.
Permanent access: what you buy is yours for as long as we operate the Service. There is no expiry, no renewal and no state in which a purchase stops working because time has passed. If we withdraw an item from sale, everyone who already bought it keeps their access to it.
Prices and taxes: prices are shown in Czech crowns, with an approximate figure in US dollars for reference. The amount charged, including any VAT or other tax that applies where you live, is shown at checkout before you pay.
Price changes: we may change our prices at any time. A change only ever applies to purchases made after it takes effect, and never to anything you have already bought.
Monthly allowances: features that call an AI or a voice engine — the tutor, audio, translation, sentence analysis, generated texts and similar — are metered, because each use costs us money every time it runs. Every account receives an allowance of each that resets on the first day of each calendar month. The current allowances are shown in your account settings. Reaching an allowance never affects your vocabulary, your drills, your streak or any path you own.
Allowances are not what you buy: they come with the account rather than with a purchase, and we may adjust them, giving notice of any material reduction. Where we offer additional credits, those are a further one-time purchase and never a recurring charge.
5. Right of Withdrawal (EU and EEA consumers)
If you are a consumer resident in the European Union or the European Economic Area, you normally have the right to withdraw from a contract concluded at a distance within 14 days, without giving any reason, under Act No. 89/2012 Coll., the Czech Civil Code (§ 1829 and following).
When that right does not apply, and what you are agreeing to. What we sell is digital content that is not supplied on a physical medium, and it becomes available in your account immediately. The law provides that the right of withdrawal is lost in that case where you have given your express prior consent to supply beginning before the withdrawal period ends, and have acknowledged that you thereby lose the right (§ 1837 of the Czech Civil Code).
We therefore ask for that consent and that acknowledgement at checkout, before taking payment. If you give it and we begin supplying the content, you no longer have a right of withdrawal for that purchase. If you would rather keep the right, do not give the consent — but we will then not be able to unlock the content until the 14 days have passed.
How to withdraw, where the right applies. Tell us by any unambiguous statement — an email to slouch.web@gmail.com is enough, and you may use the model withdrawal form set out in Czech law but are not obliged to. We will refund all payments received from you without undue delay, and in any event within 14 days of being informed, using the same means of payment you used, at no cost to you.
Outside the right of withdrawal we are not obliged to offer refunds, but we would rather have a learner than an unhappy payment. If something has gone wrong, write to slouch.web@gmail.com and we will look at it. This does not limit your rights in respect of digital content that is defective or not as described, which are unaffected by anything in these Terms.
The A1 path is free, so nothing in this section applies to it: there is no contract for payment to withdraw from.
6. Acceptable Use
You agree not to:
— Use the Service for any unlawful purpose.
— Attempt to gain unauthorised access to our systems or another user's account.
— Scrape, crawl, or systematically download content from the Service without our prior written consent.
— Use automated tools (bots, scripts) to interact with the Service in a way that disrupts its normal operation.
— Reverse engineer or attempt to extract the source code of the Service.
— Upload or transmit any content that is illegal, offensive, or infringes the rights of others.
We reserve the right to suspend or terminate your account immediately for serious violations of this section.
7. Intellectual Property
All content, software, trademarks, and materials on the Service are the property of Slouch s.r.o. or our licensors, and are protected by applicable intellectual property law. Nothing in these Terms grants you ownership of any such content.
You retain ownership of any content you create or upload (e.g. custom word lists). By uploading content, you grant us a limited licence to store and display it solely for the purpose of providing the Service to you.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
Czech Learner is a language-learning tool. We make no guarantee that use of the Service will result in language proficiency or any particular learning outcome.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Slouch s.r.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to loss of data, loss of profits, or loss of goodwill.
Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) €50.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
11. Termination
You may delete your account at any time via your account settings or by contacting us. We may suspend or terminate your access at our discretion if you breach these Terms or for any other legitimate reason, with notice where reasonably practicable.
On termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will continue to apply.
12. Governing Law and Disputes
These Terms are governed by the laws of the Czech Republic. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Czech Republic, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
If you are a consumer and we cannot resolve a complaint between us, you are entitled to out-of-court settlement. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 44, 110 00 Praha 1, coi.cz.
If you are a consumer based in the EU, you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice in the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
